An Ada man arrested Monday for allegedly possessing a large amount of marijuana, who then bonded out of jail, was arrested again Wednesday for contempt of court and given a $1 million bond.
Joshua Ben Vanhorn, 33, was charged with contempt of court after reportedly disobeying a court order.
Vanhorn was originally arrested Monday by agents with the Oklahoma Bureau of Narcotics and Ada police.
According to an affidavit filed by OBN Agent David Cowans, Ada police detectives visited a business owned by Vanhorn in the 400 block of Northwest J.A. Richardson Loop to “serve a warrant on” Vanhorn. The business, Cowans said, is open to the public.
“While attempting contact, they made the entry into an unlocked door of the business where they observed two large black trash bags filled with what appeared to be marijuana in plain view,” Cowans said. “Detectives cleared the building and backed out, calling me due to me being assigned to the marijuana unit with the Oklahoma Bureau of Narcotics.”
Cowans then responded to the scene.
“Once on scene, I contacted Jessica Maguire, the OBN registration custodian of records, who advised (Vanhorn) only has a valid OBN registration in Lehigh, Oklahoma,” Cowans said. “Maguire advised (Vanhorn) does not have an OMMA (Oklahoma Medical Marijuana Authority) license or OBN registration to store marijuana at the (Ada business location) nor was there anyone who had a valid registration at (that address). (Vanhorn) stated on his app for his OBN registration at the Lehigh location that the marijuana would be stored on-site at the grow in Lehigh.”
Cowans then spoke with Vanhorn over the phone.
“(Vanhorn) stated he did not have an OMMA license or OBN registration to have marijuana at 405 Northwest J.A. Richardson Loop,” Cowans said. “(Vanhorn) stated that the marijuana was trash marijuana from a previous business called Green Tree Capital located in Henryetta and Fitzhugh. (Vanhorn) stated that both those locations have been shut down and cleaned up and (he) did not know what to do with the marijuana.”
Cowans indicated in the affidavit that he did not believe it to be trash marijuana.
“The marijuana was packaged in multiple vacuum-sealed bags and placed into a black trash bag,” Cowans said. “The marijuana was photographed, weighed, and sent to (the Oklahoma State Bureau of Investigation) for testing. The total weight of the marijuana was approximately 18 pounds. Through my training and experience in the marijuana industry, when marijuana is packaged in vacuum-sealed bags, it is packaged for the intent to (sell).”
After being arrested and posting a $100,000 bond, Vanhorn was required to comply with a court order but failed to do so, according to Assistant District Attorney Nicholas Thurman.
“We had a search warrant requiring him to provide some information with his cell phone,” Thurman told The Ada News Friday. “He did not comply with the search warrant, which was the judge’s order ...”
Thurman indicated the District Attorney’s Office filed paperwork to revoke the $100,000 bond and change it to $1 million. After being arrested again, Vanhorn posted the higher bond and was released from the Pontotoc County Justice Center.
